Installing or using GhostFingers constitutes acceptance of these terms.

The app

GhostFingers is a free iOS app that reads public weather and ocean data and displays a surf forecast. No account is required. The core forecast is free. An optional Pro subscription, optional tips, and sponsor partnerships may be offered in the app. No personal data is sold.

Not for navigation

Wave height, wind, tide, and rating values shown in GhostFingers are model output. They are estimates, not measurements taken at the moment of reading. Ocean conditions change quickly. GhostFingers is not intended for navigation, search and rescue, commercial fishing decisions, or any other use where an inaccurate reading could result in harm.

Surf at your own risk

Surfing is a risk activity. The information shown is a forecast. It does not replace personal judgment, local knowledge, lifeguard advice, or first-hand observation of conditions at the spot. The user alone is responsible for all decisions in and around the water.

No warranty

GhostFingers is provided "as is," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The app's data sources may change, fail, or return inaccurate values. The forecast may be wrong.

Limitation of liability

To the extent permitted by law, GhostFingers and its operators are not liable for any damages (direct, indirect, incidental, special, consequential, or punitive) arising from use of the app, including injury, property loss, or missed waves.

Acceptable use

Users agree not to:

• Reverse-engineer the app for the purpose of building a competing product.
• Misuse public data sources by routing them through the app to bypass their rate limits.
• Use the app in any way that violates the laws of the user's jurisdiction.

Third-party data

The app fetches publicly available forecast data from government and public data services. Those services have their own terms and acceptable-use policies. Use of the app constitutes acceptance of those public-data terms as they apply to the user. GhostFingers does not control or endorse the accuracy of third-party data.

Changes

If these terms change, the updated version is posted at this URL with a new revision date. Continued use of the app after a change constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
